Acceptance of Deed of Dedication From Hawk Lake Hideaway, LLC, for Right-of-Way Expansion of Hexam Road, Star Road and Weeping Willow Street and Associated Resolution

BRIEF OVERVIEW

As part of the Board’s approval of the development agreement with Lake Hideaway Revocable Trust and Hawk Lake Hideaway, LLC for Lake Hideaway, a Combined-Planned Development Project, the developer was required to donate an additional 30-foot right-of-way for Hexam Road adjacent to the development’s northern boundary, an additional 20-foot right-of-way for Star Road adjacent to the development’s southern boundary, and a 135-foot right-of-way for Weeping Willow Street adjacent to the development’s eastern boundary.  The attached Deed of Dedication from developer Hawk Lake Hideaway, LLC satisfies that requirement.  It includes the right to construct, maintain, and operate, either above or below the surface of the ground, electric, light and power, water, sewer, and drainage lines and other public utilities.

 

A related resolution formally documenting the Board’s acceptance of these rights-of-way is presented for contemporaneous approval.

 

The legal descriptions for these parcels are as follows:

 

Exhibit A - Addition to Hexam Road

Commencing at the northeast corner of the southeast 1/4 OF Section 8, Township 22 South, Range 18 east, Hernando County, Florida, thence along the east line of said Section 8, Run S00º14’35”E, 99.89 feet to the south right-of-way line of Hexam Road and the point of beginning; thence leaving said south right-of-way line, continue along the east line of said Section 8 S00º20’08”E, 30.00 feet; thence S89º50’02”W, 2340.42 feet; thence N00º17’05”W, 30.00 feet to the south right-of-way line of Hexam Road; thence along said south right-of-way line, run N89º50’02”E, 2340.39 feet to the point of beginning.

RECOMMENDATION

It is recommended that the Board accept the Deed of Dedication from Hawk Lake Hideaway, LLC for public road right-of-way, and authorize staff to record the Deed of Dedication.  It is further recommended that the Board approve and authorize the Chairman’s signature on the attached associated resolution formally accepting the Deed of Dedication thereby satisfying a requirement of the Lake Hideaway Development Agreement.
