Summary of Applicant’s Request:

The applicant is proposing to develop a convenience store with 12 vehicle fueling stations (defined by the industry as individual gas dispensers with 2 fueling positions) and a possible high speed fueling lane for diesel fuel with accessory canopy structures within the front yard setback. The convenience store will be on an estimated 2 to 4 acre outparcel at the intersection of Kettering Road and SR 50.

 

Hearing History:

On January 12, 2026, the Planning and Zoning Commission voted 4-0 to recommend the Board of County Commissioners adopt a resolution approving a Master Plan Revision on property zoned PDP(GC)/ Planned Development Project (General Commercial) to include all of OP/ Office Professional uses and Specific C2 uses to establish an associated master plan with unmodified performance conditions.

 

FINANCIAL IMPACT

A matter of policy.  There is no financial impact.

 

LEGAL NOTE

The Board has the authority to make the requested rezoning / Master Plan Revision decision pursuant to Chapters 125 and 163 Florida Statutes. The Applicable Criteria for a PDP are found in Appendix A (Zoning Code), Article VIII.  The Zoning District Amendment / Master Plan Revision must be consistent with the Comprehensive Plan.

RECOMMENDATION

It is recommended that the Board adopt a resolution and authorize the Chairman to sign same, thereby approving a Master Plan revision on property zoned PDP(GC)/ Planned Development Project (General Commercial) to include all of OP/ Office Professional uses and Specific C2 uses to establish an associated master plan with performance conditions.
