Memorandums of Understanding With Florida Division of Emergency Management Under the Disaster Recovery Reform Act for Hurricane Helene and Hurricane Milton

BRIEF OVERVIEW

These Memorandums of Understanding (MOU) are entered into by and between the Florida Division of Emergency Management (FDEM) and Hernando County (County) thereafter referred to collectively as “Parties.”  The purpose of these MOU’s is to establish the obligations and responsibilities of the Parties under Section 1206 of the Disaster Recovery Reform Act (DRRA), as it relates to Federal Declaration DR-4828-FL for both Hurricane Helene and Federal Declaration DR-4834-FL Hurricane Milton.  Pursuant to these MOU’s, FDEM will assume legal responsibility for the following DRRA Section 1206 activities within County limits:

 

                     Implementation of DRRA Section 1206

                     Building code administration and code enforcement

                     Eligible floodplain management administration and enforcement

                     Completion of Substantial Damage Assessments (SDA) for eligible structures

                     Procurements and contracting necessary to complete these activities

 

FINANCIAL IMPACT

There is no financial impact associated with the recommended action.

 

LEGAL NOTE

The Board has the authority act on this matter pursuant to Chapter 125, Florida Statutes. The MOUs are effective upon its execution by both Parties and may be modified only in writing upon agreement by both Parties. The MOUs are set to expire on April 9, 2025, unless an extension is mutually agreed to in writing by the Parties.

RECOMMENDATION

It is recommended that the Board approve and authorize the Chairman’s signature on the attached Memorandums of Understandings with the Florida Division of Emergency Management for DRRA responsibilities associated with Hurricane Helene and Hurricane Milton.  It is further recommended that the Board authorize either Hernando County Fire Rescue and Emergency Services Fire Chief Paul Hasenmeier or Chief Procurement Officer, Carla Rossiter-Smith to be the designee to sign any extension or amended MOU to expedite the process.
