BRIEF OVERVIEW

On November 5, 2010, a Civil Restitution Lien Order (CRLO) was recorded in Book 2781 Page 638 of the Official Records of Hernando County, Florida against William Joseph Sly resulting from Criminal Case No. 09-CF-1900 for Lewd and Lascivious Act in the Presence of a Child Less than 16 Years Old (a second-degree felony).  Said lien is in the amount of $12,000 and has been accruing interest pursuant to Florida law since that time.  The interest owed through May 31, 2025, is $10,564.34 bringing the total amount due to $22,574.34.

 

On May 22, 2025, Kimberly Barker, Personal Representative of the Estate of William J. Sly, submitted a request that the CRLO and interest be either reduced or forgiven in entirety for the reasons explained in her attached letter. 

 

Should the Board vote to grant the request to reduce or waive any or all of the lien and/or interest, the County Attorney’s Office will prepare, sign, and record the appropriate Satisfaction of Lien.  The Clerk’s Finance Division will also at that time be directed to issue a U.S. Internal Revenue Service Form 1099 to the Estate of Joseph Sly in the amount forgiven as cancellation of debt.

 

Neither the Board nor staff will need to take any further action should the vote be to deny this request.

 

FINANCIAL IMPACT

The financial impact would be the potential future collection of the outstanding amount or forgiving and canceling the outstanding amount, depending on the Board’s decision.

The Board is authorized to act on this matter pursuant to Chapter 125, Florida Statutes.

The County Attorney’s Office makes no recommendation.  This agenda item presents purely a public policy matter, and the Board should determine whether or not it wishes to approve the request to forgive any part or all of the amount owed on the CRLO with the terms outlined above.
