BRIEF OVERVIEW

The Solid Waste and Recycling Division received an application for a commercial solid waste haulers license for construction and demolition debris (C&D) from Joseph Verilla, Owner/President, Creative Concrete &. Excavating, Inc., 2612 Merchant Avenue, Odessa, Florida 33556.

 

The Hernando County Code requires the Board of County Commissioners review the application and determine if the applicant has the ability to comply with provisions of the Code, which may be amended from time to time.  A public hearing is not required unless, after the application is reviewed, the Board determines a public hearing is in the best interest of the public.  Staff recommends a public hearing is not necessary.

 

Creative Concrete & Excavating, Inc., has attested to the Solid Waste Department that C&D will be collected and disposed of at the designated facilities. C&D may be disposed of at any facility approved by the Florida Department of Environmental Protection (FDEP) for C&D disposal.

 

The tonnage of C&D removed from Hernando County must be reported annually to the Hernando County Solid Waste Department.

 

Additionally, the amount of material recycled from collected C&D, i.e., asphalt, concrete, brick, wood, shingles, cardboard, metal, etc., must be reported to Hernando County Solid Waste Department annually.  If the amount of material recycled exceeds 600 tons per year, Creative Concrete & Excavating, Inc., must submit an annual recycling debris report to FDEP.  Hernando County Solid Waste Department must also receive a copy of the report, as the County receives credit for all recovered material that originates in Hernando County from FDEP.

 

The license authorizes Creative Concrete & Excavating, Inc., to provide commercial construction and demolition solid waste collection service within unincorporated Hernando County at large, on a free enterprise basis. Creative Concrete & Excavating, Inc., shall not provide residential service unless they have also been awarded a residential franchise by Hernando County.

 

FINANCIAL IMPACT

The commercial collection license fee of $2,000 per year will increase the revenue line item:

Fund:  4411 - Solid Waste and Recycling, Account:  3237001 - Franchise Fees-Solid Waste.

 

LEGAL NOTE

The Board is authorized to act on this matter pursuant to Chapter 125, Florida Statutes.

 

recommendation

RECOMMENDATION

It is recommended that the Board approve and authorize the Chairperson’s signature on the attached application for Creative Concrete & Excavating, Inc., with the following conditions:

 

1.                     Creative Concrete & Excavating, Inc., will collect and remove only C&D from Hernando County; and

 

2.                     The tonnage of all C&D removed from Hernando County and the tonnage of recycled material will be documented and reported to the Solid Waste Department on an annual basis. Failure to report the information will be subject to forfeit their commercial collection license.

 

Additionally, it is requested the Board authorize the Solid Waste Department to sign and issue a commercial license certificate(s) to Creative Concrete & Excavating, Inc.
