Discussion Regarding Potential Request to Terminate County’s Lease With Board of Trustees of Internal Improvement Trust Fund of State of Florida for Chinsegut Hill

BRIEF OVERVIEW
This discussion item, which has been placed on the Board’s agenda at the request of Commissioner John Allocco, requests the BOCC to consider the possibility of asking the Governor and the Cabinet, sitting as the Board of Trustees of the Internal Improvement Trust Fund of the State of Florida (the “Trustees”) to terminate or assign, in whole or in part, Hernando County’s lease of Chinsegut Hill.
The lease consists of two documents: (1) Lease Agreement #4715, dated May 28, 2013, and (2) “Amendment Number 1 to Lease Number 4715," dated November 29, 2017 (collectively, “Lease #4715”). Lease #4715's current term will expire on May 31, 2063, unless sooner terminated pursuant to the provisions of this lease.” See Paragraph 3 of the Lease #4715, as it was amended by Paragraph 1 of the Amendment.
Paragraph 28 of Lease #4715 contains the provisions governing the document’s early termination. It states, in pertinent part, that “[i]n the event no further use of the leased premises or any part thereof is needed, [the County] shall give written notification to [the Trustees] and the Bureau of Public Land Administration, Division of State Lands, State of Florida Department of Environmental Protection, . . . at least six months prior to the release of any or all of the leased premises. Notification shall include a legal description, this lease number, and an explanation of the release. The release shall only be valid if approved by [the Trustees] through the execution of a release of lease instrument with the same formality as this lease.”
Commissioner Allocco would like for the BOCC to consider requesting that the Trustees terminate Lease #4715, in whole or in part, or assigning it to with the Tampa Bay Historical Society or the City of Brooksville.
