Memorandum of Understanding With Florida Division of Emergency Management for Elevate Florida Grant Program

BRIEF OVERVIEW

The Florida Division of Emergency Management (FDEM) has developed and is administering the Elevate Florida Grant Program, funded through the Federal Emergency Management Agency (FEMA) Hazard Mitigation Assistance program under Section 404 of the Stafford Act. This program provides mitigation opportunities to residential property owners, including voluntary property acquisition and demolition to reduce future flood risk.

 

As a condition of participation, FEMA requires local governments to execute a Statement of Assurances for Property Acquisition Projects. This Memorandum of Understanding (MOU) establishes the respective roles and responsibilities of FDEM and Hernando County in meeting these federal requirements.

 

Under the MOU:

                     Participation by property owners is strictly voluntary, and no eminent domain authority will be used.

                     FDEM will manage program implementation, including appraisals, coordination, and compliance with FEMA requirements.

                     Hernando County agrees to accept and enforce deed restrictions requiring acquired properties to remain as permanent open space in perpetuity.

                     The County will assume long-term responsibilities for property maintenance, compliance reporting, and ensuring continued adherence to FEMA grant conditions.

 

The agreement also provides FDEM and its contractors access to acquired properties for demolition and site restoration activities and outlines compliance, reporting, and coordination requirements between the parties.

Goal C.2 Utilize areas of conservation lands, forestry, and waterways for passive recreation opportunities

Objective C.2.1 Identify and prioritize passive recreational enhancement opportunities aligned with the County’s Parks Master Plan, Comprehensive Plan, and the Environmentally Sensitive Lands Management Plan.

 

FINANCIAL IMPACT

There is no direct upfront financial cost to Hernando County associated with execution of this MOU.

 

However, the County will assume long-term responsibilities for maintenance of acquired properties and compliance with FEMA requirements, including periodic inspections and reporting. These ongoing obligations will be managed within existing Emergency Management programs and resources.

The Board is authorized to act on this matter pursuant to Chapters 125 and 252, Florida Statutes.

RECOMMENDATION

It is recommended that the Board approve the MOU between FDEM and Hernando County to participate in the Elevate Florida Grant Program and authorize the Chairman to execute the document.
