Amendment No. 1 to Construction Project Agreement With Charles Perry Partners, Inc., for Construction Management Services for Tax Collector Building (Contract No. 2021-RFP-GM/GC-015-TB; Amount: $13,897,476.00)

BRIEF OVERVIEW

On November 29, 2022, the Board approved awards for two contracts for the Hernando County Tax Collector Building Project:

 

                     Award of Contract to Straughn Trout Architects for Architectural and Engineering Services (Contract No. 2021-RFQ-A/E-016-TB);

 

                     Award of Contract to Charles Perry Partners, Inc., for Construction Management Services (Contract 2021-RFP-GM/GC-015-TB).

 

At that time, the total construction budget was estimated at $11,300,000.00.  The Board approvals were contingent on the completion of the land acquisition of the project site. Since then, the land acquisition of the project site has been completed.

 

On March 28, 2023, the Board provided countersignature on the award to Charles Perry Partners, Inc., (CPPI) as negotiations on the contract clarifying contract exhibits continued and were completed after the November 29, 2022 initial approval date.

 

At this time, staff has concluded the negotiations for the GMP and per contract requirements, the Construction Management Firm, Charles Perry Partners, Inc., (CPPI) has provided a (Guaranteed Maximum Price) GMP construction cost proposal in the total amount of $13,597,476.00.

 

In addition to the proposed GMP of $13,597,476.00, the department would be maintaining $300,000.00 for owner designated contingencies which may be encountered during construction, but which are not part of the GMP or contract documents.  Examples of such owner contingencies would be additional architect service fees, testing of services overruns, cost increases (e.g., utilities, permits, electricity), communications cabling or events of state mandated infrastructure system provisions.

 

CPPI obtained bids from subcontractors for materials and services and the bids are based on the construction documents as prepared by Straughn Trout Architects.  The GMP pricing proposal is based on the results of the subcontractor bids received.

 

Upon approval of the GMP proposal, construction for the Tax Collector Building would commence with CPPI utilizing the subcontractors who provided the pricing.

 

The Chief Procurement Officer has reviewed this requirement for conformance to the Hernando County Procurement Ordinance and the Hernando County Procurement Department Policies and Procedures.

 

FINANCIAL IMPACT

The Combined Tax Collector Annex is Contract No. 2021-RFP-GMGC-015-TB and No. 2021-RFQ-AE-016-TB with total funding in the amount of $13,897,476

 

The Open Gov project ID number is:  111960, with an estimated completion time of 9/30/2025.  The Account string for the project is:  Fund:  0012 - General Fund Capital Project, Department:  00012 - Capital Projects, Account:  5606201 - Bldgs-Constn and/or Imp.  Funding will be available from bond proceeds and various capital accounts.  A budget amendment is coming subsequently in anticipation of FY25 close out, upon approval.  A&E was funded via a separate fund. 

 

LEGAL NOTE

The Board has the authority to take the recommended action pursuant to Part II, Chapter 2, Article V, of the Hernando County Code of Ordinances.

RECOMMENDATION

It is recommended that the Board approve and authorize the Chairperson’s signature on attached Amendment No. One (1) to Contract No 2021-RFP-GM/GC-015-TB for construction management services for the Tax Collector building for GMP proposal from Charles Perry Partners, Inc., (CPPI) in the amount of $13,597,476.00 and approve owner contingency funds in the amount of $300,000.00.

 

It is further recommended that the Board authorize the Chief Procurement Officer to approve change orders as they become necessary and required up to allowable budget amounts.
