Acceptance of Deed of Dedication From Sexton-Harburg, LLC, for Right of Way on County Line Road

BRIEF OVERVIEW
Pursuant to Section 24-3, Hernando County Code of Ordinances, the use of Rights of Way for placement of improvements or features may be obtained by dedication to the County. This Deed of Dedication is for use of the right of way by the general public for purposes of the County road system. The definition of “County Road System” is set forth in Florida State Statute, 334.03.
This Deed of Dedication to Hernando County includes the right to construct, maintain and operate, either above or below the surface of the ground, electric, light, and power, water, sewer, and drainage lines and other public utilities.
The legal description for this parcel is as follows:
A tract of land being part of the NE ¼ of the SW ¼ of Section 35, Township 23 South, Range 18 East, Hernando County, Florida and being more particularly described as follows:
Starting at a point of beginning at the Southwest corner of Lot 33, of Linden Retreat, according to the plat recorded in Plat Book 23, Pages 33 and 34, thence, N 00°15’36”E for 40 feet thence S 89°44’24”E for 201.44 feet to a point on the right of way line of Linden Drive, thence S 00°05’59”E, 15.12 feet to a point of curvature to the Right, with a Radius of 26.44, an Angle of 82°14’29” and a Chord Bearing of S 44°24’43”W, thence N 89°38’13”W for 1.10 feet, thence N 89°43’05” W for 176.22 feet to point of beginning.

Staff recommends the acceptance of a Deed of Dedication for Parcel Key No. 1180340 for road right of way on County Line Road. A portion of the right of way will also be used for the installation of a new Strand Pole traffic signal.
FINANCIAL IMPACT
If the Deed of Dedication is accepted, the recording fees estimated at $27.00 will be paid from Account No. 1011-01352-5304923 Transportation Trust Fund, Engineering, Fees & Costs-Filing Fees.

The Board has the authority to act on this matter pursuant to Chapter 125, Florida Statutes.

RECOMMENDATION
It is recommended that the Board accept the Deed of Dedication from Sexton-Harburg, LLC for public road right of way, and authorize staff to record the Deed of Dedication.
