BRIEF OVERVIEW
The proposed ordinance would create Section 1-12 of the Hernando County Code which will provide for publication of legally required advertisements and notices on a publicly accessible website of the County, as permitted by Fla. Stat. § 50.0311.
Hernando County has an established publicly accessible website (https://www.hernandocounty.us/i-want-to/find/public-notices) which currently serves as a centralized hub for hosting legal and public notices.
Please note that the statute also requires that notice is provided at least once per year in a newspaper of general circulation or another publication that is mailed or delivered to all residents and property owners throughout the government’s jurisdiction, indicating that property owners and residents may receive legally required advertisements and public notices from the governmental agency by first-class mail or e-mail upon registering their name and address or email address with the governmental agency. A sample notice is attached to this agenda item. The County would also be required to “maintain a registry of names, addresses, and e-mail addresses of property owners and residents who have requested in writing that they receive legally required advertisements and public notices from the governmental agency by first-class mail or e-mail.”
This ordinance does not affect any publishing requirements mandated by state or federal law.
Finally, please note that Fla. Stat. §§ 50.041 and 50.051 still require the preparation of proofs of publication when public hearing notices are posted on the County’s website. A sample proof is attached hereto.
