Approval of Construction Drawing and Conditional Plat Time Extensions for Emerald Creek Subdivision

BRIEF OVERVIEW

Petitioner Northwest Land LLC is requesting an extension on the following approvals associated with the Emerald Creek Subdivision:

 

Phase 1: Construction Drawings (Application No. 1475812) - The petitioner is requesting an extension for the completion of construction from September 3, 2026, to September 3, 2027.

 

Phase 2: Conditional Plat (Application No. 1490027) - The petitioner is requesting an extension to the substantial performance deadline from June 9, 2026, to December 31, 2026. The petitioner is intending to submit construction drawings prior to this date to meet the substantial performance requirements

Chapter 26, Article II, Section 26-21 of the Hernando County Code of Ordinances allows for the developer to request a one-time extension for construction drawings for a period not to exceed 18 months, provided the effect of new or current regulations is evaluated, and the applicant agrees to comply with any new requirements as a condition of the extension. In addition, staff is recommending approval of the extension of the substantial performance requirements of the Conditional Plat.

LEGAL NOTE

The Board has the authority to act on this request in accordance with Chapter 26, Article II, Section 26-21 of the Hernando County Code of Ordinances.

RECOMMENDATION

It is recommended that the Board approve the extension of the construction drawing for Phase 1 and conditional plat for Phase 2 of the Emerald Creek Subdivision and authorize the Chairman’s signature on the attached associated letter to be forwarded by the Planning Division to Coastal Engineering Associates, the representative of Northwest Land LLC, developer of the Emerald Creek Subdivision.
