BRIEF OVERVIEW

The Solid Waste & Recycling Division received an application for a Commercial Solid Waste Collectors License for construction and demolition debris (C&D) only from Feliciano Morales, Owner/President, DGP&S Construction, Inc., 2816 N. 60th Street, Tampa, Florida 33619.

 

The Hernando County Code requires that the Board of County Commissioners review the application and make a determination that the applicant has the ability to comply with the provisions of the Code, as may be amended from time to time. A public hearing is not required unless, after review of the application, the Board determines that a public hearing would be in the best interest of the public. Staff is of the opinion that a public hearing is not necessary.

 

DGP&S Construction, Inc., has demonstrated to the Solid Waste Department that C&D will be collected and disposed of at the designated facilities approved by the Florida Department of Environmental Protection for the disposal of C&D.

 

The tonnage of C&D removed from Hernando County must be reported annually to the Hernando County Solid Waste & Recycling Division.  Additionally, the amount of material recycled from collected C&D, i.e., asphalt, concrete, brick, wood, shingles, cardboard, metal, etc., must be reported to Hernando County Solid Waste & Recycling Division annually.  If the amount of material recycled exceeds 600 tons per year, DGP&S Construction, Inc., must submit an annual Recycling Debris report to the Florida Department of Environmental Protection, and Hernando County Solid Waste and Recycling Division must receive a copy of the report. (Hernando County receives credit for all recovered material that originates in the county.)

 

This license authorizes DGP&S Construction, Inc., to provide commercial construction and demolition solid waste collection service within unincorporated Hernando County at large on a free enterprise basis. DGP&S Construction, Inc., shall not provide residential service unless they have also been awarded a residential franchise by Hernando County.

 

FINANCIAL IMPACT

The license fee of $2,000.00 per year for a commercial collection license will increase line item: Fund:  4411 - Solid Waste & Recycling, Account:  3237001 - Franchise Fee Solid Waste.

 

LEGAL NOTE

The Board is authorized to act on this matter pursuant to Chapter 125, Florida Statutes.

 

recommendation

RECOMMENDATION

It is recommended that the Board approve the application for DGP&S Construction Inc., and authorize the Chairman’s signature on the application with the following conditions:

 

1)                     DGP&S Construction, Inc., will only collect and remove C&D from Hernando County; and

 

2)                     The tonnage of all C&D removed from Hernando County and the tonnage of recycled material will be documented and reported to the Solid Waste & Recycling Division on an annual basis.  Failure to report this information will result in DGP&S Construction, Inc., being subject to forfeiture of their commercial collection license.  Furthermore, it is requested the Board’s authorization for Solid Waste staff to sign and issue a commercial license certificate to DGP&S Construction, Inc.
