BRIEF OVERVIEW
Pursuant to the September 11, 2023, Planning and Zoning Commission granted Conditional Use Permit CU-23-01 to M. Daniel Construction, Inc., for the excavation operation on Parcel Key No. 344354 located between Sunshine Grove Road and Grove Road north of Cortez Boulevard. To ensure that roadway impacts associated with the excavation operation are adequately addressed and remain consistent with other similar operations, the owner is required to enter into an agreement with the County to address maintenance and traffic control costs on Sunshine Grove Road and Grove Road. Since the Conditional Use Permit was granted, the property has come under the ownership of Waste Pro of Florida, Inc.
The impacted roads are County-owned and maintained; consequently, they are on the County’s periodic maintenance schedule, which will continue. The agreement requires the applicant to pay the County $0.75 (seventy-five cents) per truck load of material excavated from the site monthly. Staff and the owner have coordinated regarding the terms and conditions of the agreement.
The Conditional Use Permit CU-23-01 was approved from September 11, 2023, through September 11, 2026. As such, the Road Maintenance Agreement would only be valid for the duration of the Conditional Use Permit - September 11, 2026 - and both the Conditional Use Permit and the Road Maintenance Agreement would have to be renewed prior to that date to remain valid.
FINANCIAL IMPACT
The County would receive $0.75 (seventy-five) cents per truck load of excavated material from Waste Pro of Florida if the agreement is approved. Revenue collected is estimated at $3,000.00 annually and will be recognized in:
