Revocable License Agreement With Carlo Zarcone for Use of Portion of County Owned Property Located on Shoal Line Boulevard (Key #1489954)

BRIEF OVERVIEW
Mr. Carlo Zarcone owns Parcel Keys 162344 and 162353 along Shoal Line Boulevard in Hernando Beach. Previously, Mr. Zarcone had his property rezoned (H2315) to PDP(REC)/Planned Development Project (Recreational) with deviations and with modified performance conditions to allow for development of an upscale RV resort from an existing auto body and paint shop. Mr. Zarcone is currently requesting to enter into a license agreement with Hernando County for the use of a portion of the county-owned property located between Mr. Zarcone’s parcels.
The term of the license agreement would be for twenty (20) years with an option to be extended an additional two (2) terms each consisting of a ten (10) year period. Payments would be thirty cents (.30¢) per square foot (6,562 square feet in licensed area) per year for the first five (5) years and then calculated as twelve percent (12%) per annum of the then current fair market appraised value for unimproved land within the applicable area and calculated on a per square foot rate. The Current Fair Market Value shall be based upon the most recent appraisal prepared by a Florida licensed appraiser and paid for by the Licensor.
The licensed area would consist of a portion of canal and access area where the Licensed Property consists of 6,562 square feet, more or less, and is further described as:
Part of Gulf Coast Retreats Unit #8 in Plat Book 7, Page 23, of the Public Records of Hernando County, Florida. Commencing at the Point of Beginning, the Northwest corner of Lot 1, Block 104; thence N00º41’56”W for 49.72 feet; thence N89º35’32”E for 131.97 feet; thence S01º35’37”W for 49.96 feet; thence S89º40’57”W for 129.98 feet, to the Point of Beginning of Lot 1.

Impact on public access and usage of the county-owned property should be considered as well as potential benefits to the community in serving a recreational purpose from the proposed RV resort.

It is recommended for the Board to approve and authorize the Chairman’s signature on the attached license agreement with Mr. Zarcone for the use of a partial portion of Key No. 1489954.
