Request:
Expansion and Modification of Special Exception Use Permit for an existing Off-Road Vehicle Track

Summary of Applicant’s Request:
The petitioner is requesting approval of a modification and expansion to Special Exception Use Permit SE-22-02 to expand the existing off-road vehicle facility and include additional parcels.
The applicant proposes modifying the existing Special Exception Permit (“Current Permit”) by expanding the approved use to include two (2) additional parcels and revising the operational conditions of the off-road vehicle facility.
The Current Permit applies only to 16219 Citrus Way (Key No. 332214) and allows operation of an off-road vehicle track Tuesday through Friday from 9:00 a.m. to dusk, Saturday from 11:00 a.m. to 5:00 p.m., and Sunday from 11:00 a.m. to dusk for electric bikes only. This is located on the northern 20.0 acres.
The existing off-road vehicle track authorized by the Current Permit is located on the northern 20.0 acres.
The proposed modification would:
1. Add the southern 19.0 acres at 16063 Citrus Way (Key No. 332358) for parking, camping, and buffering.
2. Add the western 10.0 acres from 16398 Hodge Road (Key No. 328023) for a second off-road track limited to electric vehicles (the western 10.0 acres would be used for an additional off-road vehicle track limited to electric motorcycles and ATV use. The applicant states that the existing trees would be retained to provide a buffer from adjacent properties).
The three (3) parcels subject to the Current Permit and the proposed modification total approximately 49.6 acres and are currently zoned Agricultural.
The applicant is also requesting several modifications to the Current Permit with the addition of the 19.0 acres to the south and the 10.0 acres to the west:
1. Expand the hours of operation on Saturdays from 11:00 a.m.-5:00 p.m. to 9:00 a.m.-6:00 p.m. The property would continue to rate as an off-road vehicle track and would also offer motocross lessons and occasional vendor open-house events.
2. Allow the southern 19.0 acres to be used primarily for patron parking.
3. Allow for up to twelve (12) camping spaces with full utility connections.
(a) Camping would be limited to events and would not exceed three (3) consecutive nights.
(b) Camping will be monitored by onsite staff.
4. Allow/approve up to twelve (12) competition events per year.
(a) Each event would be limited to 500 participants and spectators.
(b) The event could last one (1) to three (3) days.
(c) Overnight parking for vendors and patrons would be allowed during these events.

FINANCIAL IMPACT
A matter of policy. There is no financial impact.
LEGAL NOTE
The Planning and Zoning Commission has jurisdiction over the subject application; the Commission has the ability to approve special exceptions with appropriate conditions and safeguards or deny special exceptions not in harmony with the Land Development Regulations. The Applicable Criteria for a special exception are contained in Appendix A, (Zoning Code) Article V, Section 8. The Special Exception must be consistent with the Comprehensive Plan.

It is recommended that the Planning and Zoning Commission approve the petitioner’s request for a Special Exception Use Permit for Expansion and Modification of Special Exception Use Permit for an existing Off-Road Vehicle Track, with performance conditions.
