BRIEF OVERVIEW

The Hernando County Board of County Commissioners approved Resolution No. 2024-205 on September 24, 2024, establishing a Master Plan for Cabot Citrus OPCO, LLC, known as Phase 1B of Cabot Citrus Farms.  The applicant has requested the County issue building permits to construct resort-residential units on the property prior to approval of the final plat.  In conjunction with this agreement, the property owner must provide the attached Property Owner’s affidavit that stipulates the restrictions and requirements associated with the issuance of building permits prior to format platting.  The applicant has also provided the following items requested by the County Attorney’s office:

 

                     A copy of the site plan of each proposed lot for development that depicts the proposed structures, setbacks, and proposed easements for each lot.

                     A signed and sealed letter by a registered professional engineer certifying that the lots for development are not located within a flood zone OR a permit to develop in a flood zone

                     A preliminary proposed subdivision plan or draft plat which indicates where the proposed lots for development will be located

                     A list of the street names or addresses for the proposed lots that are approved for access by emergency vehicles.

                     A legal description of the property (such legal description will also be in the Agreement itself).

 

FINANCIAL IMPACT

There is no monetary impact from this amendment.

 

LEGAL NOTE

The Board has the authority to act on this matter pursuant to Chapter 125, Florida Statutes.

RECOMMENDATION

It is recommended that the Board approve and authorize the Chairman’s signature on the attached Hold Harmless and Indemnification Agreement with Cabot Citrus OPCO, LLC, for Cabot Citrus Farms Phase 1B.
