BRIEF OVERVIEW
Duke Energy Florida, LLC has requested a utility easement on County-owned property (Key No. 1354493 at 17330 Spring Hill Drive). The easement will allow for the installation, operation, maintenance, and future upgrades of electric and communication facilities within a designated easement area on the parcels referenced above. The easement area is a ten-foot-wide strip along the centerline of the proposed facilities.
FINANCIAL IMPACT
The County will receive $1.00 for the easement. There is no anticipated impact on County revenues or operations.
LEGAL NOTE
The Board is authorized to act on this matter pursuant to Chapter 125, Florida Statutes.
While not illegal, the Board should be aware of the special rights it would be granting per Paragraph 9 of the proposed easement which allows Duke, “the right to install Facilities wherever needed on the Property to serve future development on the Property and adjoining lands.” This right extends to future installations which would be installed at mutually agreeable locations outside of the area in this easement’s legal description.

It is recommended that the Board grant the Utility Easement to Duke Energy Florida, LLC and authorize the Chairman’s signature on the document, with legal guidance referenced in this agenda taken into consideration.
