Proposed Ordinance Prohibiting Abandonment of Newspaper Vending Machines on Public Property

BRIEF OVERVIEW
Upon the request of Commissioner Allocco, the Board, acting by consensus during its meeting of November 19, 2024, directed the County Attorney's Office to research whether the Board could prohibit the abandonment of newspaper vending machines on public property, and if so, to prepare a proposed ordinance that does so.
The Board’s enactment of the proposed ordinance will serve the public interest by creating a procedure by which officials can remove abandoned newspaper vending machines, which are public nuisances, from public property by using the statutory process set forth in Fla. Stat. §§ 705.101 - 705.104 for the removal of personal property lost or abandoned on public property.
The proposed ordinance, if enacted, creates a new Hernando County Code § 21-6, to be entitled “Abandonment of Newspaper Vending Machines.” The proposed ordinance provides for a statement of legislative intent, definitions, prohibits the abandonment of newspaper vending machines on public property, provides for the removal of abandoned newspaper vending machines from public property, and provides for enforcement.

The Board has the authority to enact the proposed ordinance pursuant to Fla. Stat. §§ 125.01 and 705.101 - 705.104.

RECOMMENDATION
This agenda item is an issue of public policy, so no recommendation is made; however, if a majority of the Board votes to enact the proposed ordinance, the Chairman should be authorized to sign it.
