BRIEF OVERVIEW

On Tuesday July 9, 2024, the Board of County Commissioners took an initial action to increase five of the eight current impact fees from the Hernando County Code of Ordinances, Chapter 23, Article III, Divisions I-VI, relating To Impact Fees

 

FINANCIAL IMPACT

Significant impacts may be realized such as increased revenues due to a change to this County Commission policy. The magnitude of the impacts will be determined by the proposed changes that would result from changes to the policy. 

 

LEGAL NOTE

The Board has the authority to make the requested pursuant to Chapters 125 and 163, Florida Statutes, and in accordance with Chapter 23 (Planning), Article III (Impact Fee) of the Hernando County Code of Ordinances.  Florida Statutes, 163.31801 (3)(C) limits administrative charges for impact fees to the actual cost of collection.  The use of the administrative fees for studies is inconsistent with this provision of the statute.

RECOMMENDATION

It is recommended that the Board adopt increases to the County’s Impact fees schedule for Fire/EMS, Capital Facilities, Parks, Educational Facilities, and Roads.
