BRIEF OVERVIEW

An ordinance has been prepared for consideration by the Board of County Commissioners that would repeal Sec. 20-4 of the Hernando County Code of Ordinances.  If enacted, operation of all-terrain vehicles (ATVs) would again be permitted on unpaved roads so long as they are operated in accordance with F.S. § 316.2123(1) which specifies that operation be during the daytime on an unpaved roadway when the posted speed limit is less than 35 mph, by a licensed driver or a minor under the supervision of a licensed driver.

RECOMMENDATION

The Board should conduct a public hearing then vote whether or not to adopt the proposed ordinance repealing Sec. 20-4 of the Hernando County Code of Ordinances.
