Summary of Applicant’s Request:

The petitioner’s request is for approval of a Conditional Use Permit for a Second Residence on their 2.5-acre agricultural parcel for their son. The petitioner has provided a letter from a physician indicating that it would be beneficial for the petitioner’s son to live near family members for continuing care. The letter is available for review.

 

FINANCIAL IMPACT

A matter of policy.  There is no financial impact.

 

LEGAL NOTE

The Planning and Zoning Commission has approval jurisdiction over the subject application.  The Applicable Criteria for conditional use approval are contained in Appendix A, (Zoning Code) Article V, Section 4.  The Conditional Use Approval must be consistent with the Comprehensive Plan.

 

Specifically, Article V, Section 4(A)(2) permits the following, with planning and zoning commission approval: Temporary second principal building on one lot of record in cases of extreme personal hardship.

 

Article V, Section 4(E)(3) provides: "No conditional use permit shall be issued for a period to exceed two (2) years unless otherwise specified in this ordinance [article]. However, conditional use permits may be renewed or extended upon reapplication."

RECOMMENDATION

It is recommended that the Planning and Zoning Commission determine whether a hardship exists; if such a determination is made, the Planning & Zoning Commission may approve the request for a second dwelling with performance conditions.
