Amendment No. 5 to Water and Sewer Agreement With LGI Homes-Florida, LLC, for Trilby Crossing Residential Development

BRIEF OVERVIEW
On January 26, 2021, the Board approved Amendment No. 1 to the Trilby Crossing Water and Sewer Service Agreement between the Hernando County Water and Sewer District (HCUD) and LGI Homes-Florida, LLC (Developer). The amendment granted the Developer a 12-month extension to complete construction due to delays caused by the COVID-19 pandemic.
On July 13, 2021, the Board approved Amendment No. 2 to the agreement which clarified cost sharing details and allowed the Developer to purchase the required Performance and Payment bond instead of the Contractor.
On January 11, 2022, the Board approved Amendment No. 3 to the agreement which granted the Developer an additional three-month extension to complete the construction due to market conditions causing material delays and high contractor demand.
On June 28, 2022, the Board approved Amendment No. 4 to the agreement which granted the Developer an additional six months to complete construction due to the ongoing delays in manufacturing and transportation of materials caused by the nationwide increase in construction activity.
Amendment No. 5 allows reimbursement to the contractor for costs incurred for the purchase of additional materials installed at HCUD's direction that were out of the project's scope. The contractor will be reimbursed by the Developer for the materials cost of $7,116.40, and reimbursement to the Developer will be made by HCUD through this Agreement Amendment No. 5.
FINANCIAL IMPACT
The Hernando County Water and Sewer District (HCUD) will reimburse the Developer in the amount of $7,116.40 as per the agreement. Funding is available in Fund 4132 (HCUD Connection Fee-Water), Department 07213 (Connection Fees-Water), Account 5666529 (CIP-Lockhart Wellfld/WTP).
