BRIEF OVERVIEW

Jerrod Zelanka has submitted a petition to vacate a portion of a 20’ Drainage Right-of-Way (DROW) and an adjacent 6’ Drainage ad Utility Easement within Lot 5, Block 1536, of Spring Hill Unit 22 as recorded in the Plat Book 16, Page 74-75, of the Public Records of Hernando County, Florida, located at 4112 Valley Brook Court. The vacation is sought in order to expand his residence. The petitioner also owns the vacant lot on the other side of the DROW.

 

The Department of Public Works (DPW) has objected to the request.  All other affected utilities and County departments have indicated no objection.

A matter of policy. There is no financial impact.

 

LEGAL NOTE

The Board has the authority to act on this matter pursuant to County Policy No. 19-07 and Sections 177.101 and 125.01, Florida Statutes.

RECOMMENDATION

It is recommended that the Board take public comment on the request and deny the Vacation of the Easement on the basis of DPW’s objection.  Alternatively, should the Board vote to approve the petition, the Chairman should be authorized to sign the attached proposed resolution after which it will be recorded in the Public Records of Hernando County, Florida.  No resolution is needed if the decision is for denial.
