BRIEF OVERVIEW
The Southwest Florida Water Management District (SWFWMD) and Hernando County partnered and combined resources through a Cooperative Funding Agreement entered into on October 1, 2018, for design, permitting and construction of stormwater BMPs to retrofit multiple existing urban drainage retention areas with denitrification cells utilizing biosorption activated media (BAM). The retention areas are within three miles of the Weeki Wachee Springs headspring.

The Cooperative Agreement is effective October 1, 2018, through June 30, 2022, or upon satisfactory completion of the project and subsequent reimbursement to the District, whichever occurs first, unless amended in writing by the parties.

Attached for the Board's review and approval is a First Amendment to the Agreement extending the expiration date of the Agreement from June 30, 2022, to June 30, 2024, amending the performance/project schedule timeline, and updating the project managers/contacts. In order for the First Amendment to be processed for approval prior to the June 30, 2022 expiration date, the County Administrator, as a duly representative for Hernando County, executed the amendment for the SWFWMD Board to review and approve at its June 21, 2022 meeting. It is recommended the Board approve and ratify the County Administrator's signature on the attached First Amendment to Agreement.

FINANCIAL IMPACT
There is no financial impact extending the expiration date of the agreement. Project funding is currently budgeted within the Stormwater Management MSTU Fund account 7552-09552-5606309 (Improvements-Stormwater).

LEGAL NOTE
The Board has the authority to take action on this matter pursuant to Chapter 125, Florida Statutes.
