Consideration of Request to Forgive Interest Fees Resulting From Two Outstanding Civil Restitution Lien Orders Filed Against James Richard Baker, Jr.

BRIEF OVERVIEW
On March 18, 2011, a Civil Restitution Lien Order (CRLO) was recorded in Book 2810, Page 627 of the Official Records of Hernando County, Florida against James Richard Baker, Jr. resulting from Criminal Case No. 11-MM-247 for DUI-1st Offense (a first degree misdemeanor), Possession of Medicinal Drug without Prescription (a second degree misdemeanor), Possession of Marijuana Less than 20gms (a first degree misdemeanor), and Possession of Paraphernalia (a first degree misdemeanor). Said lien is in the amount of $4,500.00 and has been accruing interest pursuant to Florida law since that time. The interest owed through May 31, 2025, is $3,843.26.
On December 5, 2011, a second CRLO against James Richard Baker, Jr., was recorded in Book 2865, Page 998 of the Official Records of Hernando County, Florida resulting from Criminal Traffic Case No. 11-CT-3324 for Knowingly Driving While License Suspended (a second degree misdemeanor). Said lien is in the amount of $500.00 and has been accruing interest pursuant to Florida law since that time. The interest owned through May 31, 2025, is $321.37. The total interest associated with both CRLO's is $4,164.63.
On April 13, 2025, Mr. Baker asked that the accrued interest in both CRLO's be forgiven for the reasons explained in his attached email. He is prepared to pay the combined principal amount owed of $5,000.00.
Should the Board vote to grant the request, the County Attorney's Office will sign and record the attached Satisfactions of Lien and the Clerk's Finance Division will be directed to issue Mr. Baker a U.S. Internal Revenue Service Form 1099 in the amount forgiven as cancellation of a debt.
Neither the Board nor staff will need to take any further action should the vote be to deny Mr. Sterling's request for forgiveness.
