Ordinance Amending Legal Description of Lake Hideaway II Community Development District to Correct Scrivener’s Error

BRIEF OVERVIEW
On April 14, 2026, Hernando County entered into a contract whereby it would purchase a portion of Key No. 343131 from Hawk Lake Hideaway, LLC. A copy of the contract is attached hereto.
Prior to the closing, the title insurer discovered that Hernando County Code § 10.5-85.2.3, which creates the Lake Hideaway II Community Development District (the “CDD”), contains a scrivener’s error. Specifically, the pertinent part of the CDD’s legal description should read “THENCE N 00 17’05” W, 465 FEET,” but instead it reads ““THENCE N 00 17’05” W, 330 FEET.” A copy of Ordinance 2024-17, from which Hernando County Code § 10.5-85.2.3, is attached with the scrivener’s error highlighted. As a result, the CDD encroaches on the parcel that the County is buying from Hawk Lake Hideaway, LLC., by 135 feet. This discrepancy has prevented the closing of the transaction.
To remedy the problem, Hawk Lake Hideaway, LLC, has prepared a new legal description and property sketch for the CDD. This proposed ordinance will correct the CDD’s legal description, which will allow the real estate transaction to close.
Hawk Lake Hideaway, LLC, and its legal counsel have agreed to this solution of the problem.
