BRIEF OVERVIEW
On November 10, 2025, the P&Z voted 3-2 to deny a Special Exception Use Permit for a place of public assembly, namely a venue for special events, as petitioned by Steven Berry and Christine Berry (SE2514).
On December 2, 2025, the Board of County Commissioners voted to hear the appeal filed by the petitioners, Steven Berry and Christina Berry, regarding the denial of Special Exception Use Permit SE2514. The appeal was scheduled for January 6, 2026.
The petitioners requested that the appeal hearing be rescheduled to February 3, 2026, citing the need for adequate time to compile the required documentation pertaining to road utilization.
Staff has no objection to the petitioners’ request to reschedule the appeal hearing to a later date.

There is no financial impact for this request; a matter of policy only.
LEGAL NOTE
The initial review of the decision by the Board shall be at a public hearing held within sixty (60) days of the P&Z’s decision.
The Board is authorized to consider the petitioners’ request for rescheduling pursuant to Appendix A (Zoning), Article V (Administration), Section 8(I) (Special Exception Use Regulations) of the Hernando County Code of Ordinances, which states that the Board, by motion or written request of any party with standing, or by its own motion, may extend or continue the time-framed hearing for a reasonable period.

RECOMMENDATION
It is recommended that the Board authorize rescheduling the appeal on Special Exception Use Permit SE2514 to February 3, 2026, in accordance with the petitioners’ request.
