Discussion Regarding Sidewalk Requirements as Contained in Hernando County Code

BRIEF OVERVIEW

At the November 7, 2023, meeting, the Board requested additional information on the requirements for sidewalk installation as required by the Hernando County Code along collector and arterial streets.  Ordinance No. 2016-11 was adopted on July 12, 2016, requiring sidewalk installation on all designated arterial and collector roads.  A copy of the Ordinance and Section 26-52 of the Hernando County Code are attached for the Board’s reference.

 

The Ordinance requires that sidewalks shall be constructed for the length of the site frontage along all adjoining roadways in conjunction with all new construction under the following conditions:

 

a)                     The site is located on a county designated arterial or collector street;

 

The Code does contain a provision that the County Engineer may permit the waiver of the construction, as well as a provision that the County Engineer may require a County Contribution to the County sidewalk fund as a condition of granting the waiver.

 

The Engineering Department has been requiring a contribution as a condition of granting the waiver.  In the past three (3) fiscal years, the County has received sidewalk contributions in the amount of:

 

                     FY21                     $14,150

                     FY22                     $20,750

                     FY23                     $87,325

It is recommended the Board discuss and provide direction regarding the interpretation and application of Ordinance No. 2016-11.
