BRIEF OVERVIEW
The April 2024, Impact Fee Study prepared by Stantec indicates that extraordinary circumstances exist that allow the County to increase Impact Fees beyond the standard limits specified by Florida Statutes for the County’s Roads, Fire, Emergency Medical Services (EMS), Public Buildings, Law Enforcement, Libraries, Parks & Recreation, Correctional and Educational facilities. The Board should consider the results of this study, the demonstrated needs indicated within, and consider which of the Impact Fees should be increased, and by what amount.
FINANCIAL IMPACT
Significant impacts may be realized such as increased revenues due to a change to this County Commission policy. The magnitude of the impacts will be determined by the proposed changes that would result from changes to the policy.
Florida Statutes, 163.31801(3)(C) limits administrative charges for impact fees to the actual cost of collection. The use of the administrative fees for studies is inconsistent with this provision of the statute.

The Board has the authority to act on this matter pursuant to Chapters 125 and 163, Florida Statutes, and in accordance with Chapter 23 (Planning), Article III (Impact Fees) of the Hernando County Code of Ordinances.

RECOMMENDATION
It is recommended that the Board review the 2024 Impact Fee Study, conduct a public hearing, and consider increases to the County’s Impacts Fees as appropriate.
