1.                     The applicant is requesting a variance to reduce right side setbacks from 20’ to 6’.  Per Muni Code:  Appendix A - Zoning, Article IV - Zoning District Regulations, Section 3 - Commercial District, (D) Dimension and area regulations, (2) Minimum side yard requirement: The minimum side yard requirement in all commercial districts is twenty (20) feet.

2.                     Based on the Review Criteria under Section 3 Appeals and Variances The petitioner has not provided a clear hardship in listed with the criteria.

RECOMMENDATION

It is recommended that the Board review the variance, find the request is not consistent with the review criteria of Section 3 Appeals and Variances.  The petitioner has not provided a clear hardship listed with the review criteria.  It is further recommended that the Board approve and authorize the Chairman’s signature of the attached associated resolution.
