BRIEF OVERVIEW
Hernando County and the Hernando Beach Property Owners' Association have been parties to a longstanding license agreement from November 2013 for the maintenance of Triangle Park (at the intersection of Shoal Line Boulevard and Osowaw Boulevard), and Dolphin Fountain (at the intersection of Osowaw Boulevard and Commercial Way).

On September 10, 2025, the Association's President provided a written request for the agreement to be terminated. Notwithstanding the inability to locate a fully executed copy of the agreement, Hernando County recognizes the attached document from 2013 as the existing agreement in order to memorialize the terms and inform the Board of the Association's decision to terminate the current maintenance agreement.

The termination will conclude the Association's maintenance responsibilities for the designated areas. Following termination, the County will assume maintenance duties for the continued upkeep of Triangle Park and the Dolphin Fountain.

Staff recommends the Board acknowledge the Hernando Beach Property Owners' Association notice to terminate the license agreement and direct staff to assume maintenance responsibilities of Triangle Park and the Dolphin Fountain.

FINANCIAL IMPACT
The financial impact to the County is $3,000.00, which has already been budgeted for the maintenance of Triangle Park and the Dolphin Fountain resulting from the termination of the agreement.
