BRIEF OVERVIEW
CSX Transportation, Inc., and Hernando County entered into a Sidetrack Agreement dated November 15, 2022, covering the construction, ownership, operation, and maintenance of certain private sidetrack facilities near Milepost SR806.01, Brooksville, Hernando County. This Supplemental Sidetrack Agreement is between CSX Transportation, Inc., Hernando County and Barrette Outdoor Living, Inc., for the use of the railroad tracks. This agreement replaces the agreement approved on January 10, 2023, which was never fully executed due to Barrette Outdoor Living, Inc., requesting a reduction of liability insurance from $5,000,000 to $2,000,000.
FINANCIAL IMPACT
The Airport’s revenue will not be impacted.
LEGAL NOTE
Reviewed and approved for form and sufficiency by the County Attorney’s Office. The Board is authorized to act on this matter pursuant to Chapter 125, Florida Statutes.

It is recommended that the Board approve and authorize the Chairman’s signature on the attached Supplemental Sidetrack Agreement between CSX Transportation, Inc., Hernando County, and Barrette Outdoor Living, Inc.
