Ordinance Amending On-Site Sewage Disposal Systems to Update Regulations Regarding Septage Hauling Services

BRIEF OVERVIEW

This ordinance will amend the County Code Chapter 28 Article V (On-site Sewage Disposal Systems), which deals with the regulation of the hauling and disposing of septage and portable toilet waste within the County. There are several revisions proposed, some of which are summarized below:

 

                     Clarifies the requirement for septage haulers to obtain a license from the State (regulatory authority) to pump and haul septage within the County.

 

                     Clarifies the requirement for septage haulers to obtain a permit from the County to haul and dispose of septage and portable toilet waste at the County’s septage receiving stations.

 

                     Establishes that records of the date, time, address, description of material, and origin of the septage shall be made available while offloading at the County’s septage receiving stations.

 

                     Establishes that compliance of the County permit requirements for hauling and offloading of septage and portable toilet waste shall be enforced by the Hernando County Utilities Department Director, which has the authority to suspend or revoke privileges for improper use of the facility.  A permittee may appeal an enforcement determination made pursuant to this article to the Board of County Commissioners.

The Board has the legal authority to act on this item per Florida Statute, Section 125.

RECOMMENDATION

It is recommended that the Board approve and authorize the Chairman’s signature on the attached ordinance amending on-site sewage disposal systems to update regulations regarding septage hauling services.
