BRIEF OVERVIEW
Hernando County Planning Department File Number H-22-23, A&I Land Association, LLC applied to the County to rezone property from AG (Agricultural) to PDP(HHC)/Planned Development Project (Heavy Highway Commercial) for a Truck Service Establishment.

On November 14, 2022, the Planning and Zoning Commission voted 4-0 to recommend the Board of County Commissioners adopt a resolution approving a rezoning from AG(Agricultural) to PDP(HHC)/Planned Development Project (Heavy Highway Commercial) for a Truck Service Establishment, with modified performance conditions.

On December 13, 2022, a public hearing was conducted on the application to rezone from AG (Agricultural) to PDP(HHC)/Planned Development Project (Heavy Highway Commercial) for a Truck Service Establishment and the Hernando County Board of County Commissioners denied the application.

On May 15, 2023, A&I Land Association, LLC, filed its Request for Relief under the Florida Land Use and Environmental Dispute Resolution Act ("FLUEDRA").

On July 27, 2023, Hernando County staff and A&I Land Association, LLC Tampa, FL attended mediation on the dispute and then prepared the Mediated Settlement Agreement.

On October 7, 2024, the Mediated Settlement Agreement was fully executed.

FINANCIAL IMPACT
None. Each party shall bear its own attorneys' fees.

LEGAL NOTE
The Board has the authority to approve this Mediated Settlement Agreement pursuant to Section 70.51(17) of the Florida Statutes.

It is recommended that the Board adopt and authorize the Chairman's signature on the attached resolution approving the proposed settlement agreement thereby (1) resolving the legal challenge pursuant to Section 70.51, Florida Statutes and (2) approving A&I Land Association, LLC Planning Department application H-22-23 with the additional conditions as outl...
