This item was postponed from the November 10, 2025, Planning and Zoning Commission hearing as the applicant’s sister is a co-owner of the property and also needed to submit an application. This application has been received, and the item can now be considered by the commission.

LEGAL NOTE

The Planning and Zoning Commission has jurisdiction over the subject application.  The Applicable Criteria for conditional use approval are contained in Appendix A, (Zoning Code) Article V, Section 4.  The Conditional Use Permit must be consistent with the Comprehensive Plan.

RECOMMENDATION

It is recommended that the Planning and Zoning Commission determine whether a hardship exists; if such a determination is made, the Planning & Zoning Commission may approve the request for a Conditional Use Permit for a Second Residence Due to Medical Hardship with performance conditions.
