Proposed Ordinance Correcting Scrivener’s Error in Hernando County Code Adopting Extra Gain-Time Procedures for Prisoners at Hernando County Jail

BRIEF OVERVIEW
Hernando County Code § 21-124 provides for the commutation of time for meritorious conduct or exceptional industry (i.e., extra gain-time) for prisoners in the Hernando County Jail. The Sheriff’s Office has identified a scrivener’s error in § 21-124 that needs to be corrected: to wit: Fla. Stat. § 951.21 authorizes counties to award county inmates up to five (5) days per month of extra gain-time, while the County’s ordinance provides for extra gain-time awards of up to six (6) days per month.
The proposed ordinance will bring the County’s ordinance in line with the state’s enabling statute. In other words, Hernando County Code § 21-124 will provide for extra gain-time awards of up to five (5) days per month upon adoption of the proposed ordinance.
FINANCIAL IMPACT
No increase in cost.

The Board has the authority to enact the proposed ordinance pursuant to Fla. Stat. §§ 125.01 and 951.21.
