Appeal of Notice of Unsafe Building Against Property Located at 3273 Mangrove Drive

BRIEF OVERVIEW

Ferris S. Waller TTEE, represented by R. Bruce Snow, Esq., is appealing a Notice of Unsafe Building (Building Case File No. 344258) issued on May 7, 2025, pertaining to Property Key No. 154594, at 3273 Mangrove Drive, Hernando Beach, FL 34607, which is owned by the appellant. The Notice of Appeal, which includes a summary of the reasons for the appeal, is attached.  Also, attached are photographs, owner information, the Preliminary Notice of Unsafe Building (dated September 8, 2022), the Notice of Unsafe Building, and the building inspector’s chronology notes.

 

This appeal proceeding is governed by Hernando County Code of Ordinances, Chapter 8 (Building and Building Regulations), Article II (Construction Code), Div. 6, which adopts and amends the Standard Unsafe Building Abatement Code. A copy of the Standard Unsafe Building Abatement Code is also attached.

 

Notice of this hearing was served upon all interested parties in accordance with Ch. 8, Art. II, Div. 6 of the Code.  Pursuant to Hernando County Code Ch. 8, Art. II, Subdivision B, the Board of Construction and Regulation (BCR) is authorized to hear appeals of the Building Official’s decisions; however, the BCR currently lacks a quorum in order to conduct business.  By virtue of Fla. Stat. s. 125.01 and Fla. Const. Art. VIII, s. 1, the Board of County Commissioners is authorized to substitute for the BCR to hear the appeal.
