Hearing Detail:
On August 27, 2024, the Board of County Commissioners voted to pull the Special Exception Use Permit from the consent agenda for it to be heard for discussion on September 24, 2024.

A matter of policy. There is no financial impact.
LEGAL NOTE
The Board has jurisdiction over the subject application pursuant to Chapter 125, Florida Statutes; the Board has the ability to approve special exceptions with appropriate conditions and safeguards or deny special exceptions not in harmony with the land development regulations. The applicable criteria for a special exception are contained in Appendix A, (Zoning Code) Article V, Section 8. The special exception must be consistent with the Comprehensive Plan.

RECOMMENDATION
It is recommended that the Board review the Planning and Zoning decision on the petitioner’s request for a special exception use permit for a place of public assembly, namely an outdoor farmer’s market with performance conditions. A resolution will be brought back to the Board ratifying the Board’s decision of either denial or approval.
