BRIEF OVERVIEW
On May 22, 2023, with the assistance of a mediator, representatives of the parties in the case Hernando County v. Hernando County Fair Association, Inc. (Florida Fifth District Court of Appeal case no. 5D23-1060, Hernando County Court Case No. H-27-CC-2021-1454) agreed to a proposed settlement. The proposed settlement agreement also addressed resolution of Hernando County Case No. H-27-2022-CA-338. The Board of County Commissioners discussed the appropriate amount of payment from the Hernando County Fair Association, Inc. to settle the disputed amount in H-27-2022-CA-338 during a “shade tree” meeting before the start of its June 13, 2023, meeting. The Board must now conduct any action it wishes to take concerning the proposed settlement while in open session.

The County Attorney’s Office recommends that the Board of County Commissioners accepts the terms of the proposed settlement.
