BRIEF OVERVIEW

On July 27, 2026, the County Attorney’s Office and County Administrator mediated a proposed Stipulation of Agreement to settle the case Hernando County v. Hernando County Fair Association, Inc. (“HCFA”) (Hernando County Court Case No. H-27-CC-1454).  Hernando County sued HCFA to force its compliance with the terms of the May 26, 2008, Memorandum of Agreement and Performance Agreement.  The parties came to a tentative settlement in mediation wherein HCFA will pay Hernando County $12,000 in attorney fees in monthly allotments, post a $5,000 performance bond, and present its current Master Plan and redevelopment report to the Board of County Commissioners at its meeting of October 27, 2026.  Several other terms are detailed in the attached stipulation. 

 

This proposed settlement was considered by the Board in executive session prior to the start of its August 11, 2026, meeting.  The Board must now conduct any action it wishes to take concerning the proposed settlement while in open session.
