Proposed Resolution Requesting Hernando County School Board Dedicate or Otherwise Transfer Explorer Boulevard to Hernando County for Extension, Improvement and Inclusion in County Road System

BRIEF OVERVIEW
On November 29, 2022, Hernando County entered into a Development Agreement with Somerset Land, LLC that governs the latter's development of a real estate development which is to be known as "Somerset Bay." Pursuant to Section 13(c)(i) of the Development Agreement, the subdivision's eventual developer must improve "approximately 1,300 linear feet of Explorer Boulevard to 4-lane collector road status, said improvements being made within the existing right-of-way for Explorer Boulevard" from the intersection of Northcliffe Boulevard south to the Explorer K-8 school. The Hernando County School Board owns Explorer Boulevard.
In a letter dated October 22, 2024, Darryl W. Johnston, Esq., requested on behalf of his client, Acts 88, LLC, that the Hernando County Board of County Commissioners pass a resolution requesting the Hernando County School Board to transfer Explorer Boulevard to Hernando County. Acts 88, LLC, the developer of Somerset Bay, maintains that the above-described roadway transfer is a prerequisite to the company's improvement of Explorer Boulevard to collector road status.
FINANCIAL IMPACT
FY 2025 and annual funding impact to Public Works for general roadway maintenance will be funded by the following:
Fund: 1011 - Transportation Trust, Department: 03051 - Road Maintenance, Account: 5305301 - Materials-Road ($2,000)
Fund: 7552 - Storwmater Mgmt MSTU, Department: 09552 - Stormwater Mgmt MSTU, Account: 5303401 - Contract Services ($200)
