Mutual Aid Agreement for Water/Wastewater by Hernando County Water and Sewer District for Immediate Relief for Utilities During Emergencies

BRIEF OVERVIEW
In 2005, Hernando County Water and Sewer District (HCUD) joined the network Florida's Water/Wastewater Agency Response Network (FlaWARN) "utilities helping utilities" to address mutual aid during emergency situations (see attached original agreement). The goal of FlaWARN is to provide immediate relief for member utilities during emergencies. The agreement's authorized representative list (Appendix A) has been updated with current contacts along with the signature page.
FINANCIAL IMPACT
Expenses would be reimbursable for personnel, equipment (at established rates), and materials & supplies. Unless mutually agreed otherwise, the assisting utility should bill the requesting utility for all expenses not later than 90 days following the Period of Assistance.
The requesting utility shall pay the bill in full not later than forty-five (45) days following the billing date. Unpaid bills shall become delinquent upon the forty-fifth (45th) day following the billing date, and once delinquent shall accrue interest at the rate of prime plus two percent (2%) per annum as reported by the Wall Street Journal.

The Board has authority to act on this matter pursuant to Chapter 125, Florida Statutes.

RECOMMENDATION
It is recommended that the Board, on behalf of the Hernando County Water and Sewer District, approve and authorize the Chairperson’s signature on the attached Mutual Aid Agreement for Water/Wastewater. It is further recommended that the Board approve and authorize staff to record the agreement in the Public Records of Hernando County.
