BRIEF OVERVIEW

The Legislature amended the “Florida Impact Fee Act,” Fla. Stat. § 163.31801, in 2021. The Legislature added a second definition of infrastructure, to wit: “The term also includes a fire department vehicle, an emergency medical service vehicle, ...  and the equipment necessary to outfit the vehicle ... for its official use.” Fla. Stat. §163.31801(3)(a). The Legislature also specified that the term “public facilities” specifically “includes emergency medical, fire, and law enforcement facilities.”  Fla. Stat. §163.31801(3)(b).  The proposed ordinance incorporates these changes into Hernando County Code Section 23-44.
