Approval of Liquidated Damages for Taxiway A Rehabilitation Project at Brooksville-Tampa Bay Regional Airport (Contract No. 19-CG0119; Amount: $284,876.08)

BRIEF OVERVIEW

Contract No. 19-CG0119 was originally awarded to D.A.B. Constructors, Inc., and was assumed by Western Surety in January of 2022, due to D.A.B. Constructors, Inc.’s bankruptcy.  The Airport contracts with American Infrastructure Development, Inc. (AID) to manage this contract and the Taxiway A Rehabilitation project.  AID sent notification to Western Surety that beginning July 8, 2022, Liquidated Damages were being assessed at $3,645 per day on this project.  Western Surety passed the responsibility to pay assessed Liquated Damages to their contractor for the project, Civil Site Constructors, Inc. 

 

Substantial completion was met on November 17, 2022, 133 days over the contracted allowable time. The computed Liquidated Damages for the project at $3,645 per day for 133 calendar days totals $484,785.00.  After negotiation, and with department and Chief Procurement Officer (CPO) approval, Hernando County has agreed to assess liquidated damages in the amount of $284,876.08.

 

FINANCIAL IMPACT

$284,876.08 to be deducted from final payment of Contract No. 19-CG0119.

It is recommended that the Board approve the assessment of $284,876.08 in Liquidated Damages for Contract No. 19-CG0119.
