Ordinance Concerning Local Specialty Contracting Licensing; Delaying Effective Date of Ordinance 2021-17 Eliminating Certain Specialty Contractor Licenses

BRIEF OVERVIEW
On September 14, 2021, the Board of County Commissioners adopted Ordinance No. 2021-17 to eliminate 12 specialty contractor license categories in order to comply with newly enacted Chapter 2021-214, Laws of Florida. The law allowed current licenses to continue until July 1, 2023. The license categories are Steel Erection, Excavation, Insulation, Structural Concrete, Structural Carpentry, Masonry, Accessory Structure, Aluminum Fabricating, Fence, Tree, Tile, Plastering & Stucco.
The Legislature has now enacted Chapter 2023-271, Laws of Florida, to allow for a year’s extension of the eliminated specialty licenses to July 1, 2024. The Building Division therefore proposes that an ordinance be adopted to delay the effective date of Ordinance No. 2021-17 to July 1, 2024. Because the proposed new ordinance is not being considered until after the previously declared effective date to eliminate the specialty licenses, the new ordinance must be nunc pro tunc or retroactive to June 30, 2023.

RECOMMENDATION
It is recommended that the Board adopt an ordinance, nunc pro tunc to June 30, 2023, delaying the elimination of 12 specialty contractor license categories until July 1, 2024, and authorizing the Chairman’s signature thereon.
