Memorandum of Understanding Between Cabot Citrus OPCO, LLC, and Hernando County Water and Sewer District for Construction of Force Main and Infrastructure for Cabot Citrus Farms

BRIEF OVERVIEW
On March 14, 2023, Cabot Citrus OPCO, LLC (Developer) and Hernando County Water and Sewer District (HCUD) entered into a Water and Sewer Service Agreement for the proposed Cabot Citrus Farms Development. On May 9, 2023, the Developer and the County entered into a Hold Harmless Agreement to allow the Developer to apply for and receive building permits for the Development prior to final plat approval. To help expedite the Cabot Citrus Farms development project, the attached Memorandum of Understanding (MOU) will allow HCUD to accept connections fees prior to the Developer constructing the necessary force main and other infrastructure required to provide sewer service to the development. Approval of this MOU will assist the developer with obtaining building permits while the sewer infrastructure is being constructed.
FINANCIAL IMPACT
No financial impact.

The Board has the authority to act on this matter pursuant to Chapter 125, Florida Statutes.

RECOMMENDATION
It is recommended that the Board, on behalf of the Hernando County Water and Sewer District, approve the Memorandum of Understanding with Cabot Citrus OPCO, LLC, authorize the Chairman to execute the agreement, and have staff record the Agreement in the Public Records of Hernando County.
