BRIEF OVERVIEW
The Hernando County Board of County Commissioners has previously endorsed the acquisition of a portion of p
Parcel Key No. 346860 to facilitate road improvements crucial for enhancing safety and advancing the county's infrastructure. Parcel Key No. 346860 located southwest of the intersection at Cortez Boulevard (S.R. 50) and Barclay Avenue contains a portion of land vital for the planned improvements.

Staff is requesting the board approve the resolution regarding the acquisition of the necessary portion of Parcel Key No. 346860. Additionally, authorization is sought to empower the County Attorney's Office to initiate litigation in order to acquire the necessary portion of Parcel Key No. 346860. This action aligns with the Board's commitment to prioritize public safety and enhance the County's transportation network. Litigation is deemed necessary to secure the portion of parcel Key 346860 essential for implementing the planned road improvements.

County staff has successfully negotiated an agreement with the property owner of Parcel Key No. 346860, Register Family, LLC and the owner of the business on the property, Register Chevrolet, Inc., regarding the condemnation of the property. Through mutual understanding, a stipulation has been reached to facilitate the legal condemnation process without objection from Register Family, LLC and Register Chevrolet, Inc.

The County has tentatively agreed with the property owner and business owner on the following terms to ensure an undisputed eminent domain action:

Compensation: The property owners will receive fair and just compensation for the acquisition of their parcel. This condemnation will proceed through an undisputed eminent domain action, minimizing any potential legal challenges.
